Terms of Service

These terms are an agreement between you and Mythical Creature, LLC, which runs ProdKit. By creating an account or using ProdKit, you agree to them. The Privacy Policy explains what data we collect and why.
1. Who provides ProdKit
ProdKit is a product of Mythical Creature, LLC, a Delaware limited liability company ("we" or "us"). We also run other products. These terms cover only ProdKit: the website at www.prodkit.cloud, the dashboard, the image endpoint at img.prodkit.cloud, and paid plans.
Charges for ProdKit appear on card statements and receipts as Mythical Creature or ProdKit.
2. Accounts and eligibility
- You must be at least 18 and able to form a binding contract. ProdKit is built for developers and businesses.
- If you sign up for a company or other organization, you confirm that you can bind it to these terms, and "you" means that organization.
- You sign in with a one-time code sent to your email address, or with GitHub if that option is shown. Anyone who can read your sign-in codes can use your account, so keep that inbox or GitHub account secure. You're responsible for activity in your account. If you think someone else has access, email support@prodkit.cloud right away.
- Use an email address you read. We send sign-in codes and important notices about your account and billing there.
- Don't create accounts by automated means, or open extra accounts to get more Free plan usage.
- You can't use ProdKit if US law, including US sanctions, bars you from receiving it.
3. The service
ProdKit transforms and delivers images from storage buckets you control. When you connect a project, you give us the public URL of a Supabase Storage bucket. When someone requests an image at img.prodkit.cloud, ProdKit fetches the original from that bucket, resizes and converts it with Cloudflare Images, caches the result on Cloudflare's network, and keeps a copy of each generated size in Cloudflare R2 storage for up to 180 days so it isn't transformed again. The dashboard shows your usage and recent requests.
Your originals stay in your bucket. ProdKit only reads from it: it never uploads, changes, or deletes your files.
Image URLs served by ProdKit are public, so anyone who has one can load the image. Only connect buckets that hold images you mean to publish.
You can disconnect a project from its page in the dashboard. Its image URLs stop working within about a minute, its name in those URLs can't be used again, and usage already recorded that month still counts toward your plan.
The ProdKit SDKs are licensed under the MIT License. That license, not these terms, governs your use of the SDK code.
4. Your content
Your images, file names, and project settings are your content, and you keep all rights to it. You give us a worldwide, non-exclusive, royalty-free license to fetch, transform, cache, store transformed copies of, and deliver your content, only as needed to provide, secure, and support ProdKit for you. The license ends once we no longer hold copies, as described in the Privacy Policy.
You confirm that you own your content or have the rights needed to serve it through ProdKit, and that serving it doesn't break the law or anyone else's rights.
We don't look at your images except to run the service, investigate a report of abuse, or comply with the law. We don't sell them or use them to train AI models.
When you replace or delete a file in your bucket, ProdKit stops serving the old version within about a day. Browsers and other caches outside our control may keep copies longer.
5. Data processing
Your images, and the requests your app's visitors make for them, can include personal data. For that data you are the controller and we are your processor. We process it only to provide ProdKit as these terms describe, which are your instructions to us, and not for any purpose of our own.
People who work on ProdKit are bound to keep it confidential. We protect it with the measures described in the Privacy Policy, which also lists the providers (subprocessors) we use. We'll update that list before adding a new provider, and you can object by email. We'll tell you without undue delay if we learn of a breach affecting your data, help you answer requests from the people it concerns, and delete it when your account is deleted, as the Privacy Policy describes. Transfers outside the EU and UK rely on the European Commission's standard contractual clauses and the UK addendum.

6. Acceptable use
Don't use ProdKit to:
- serve or link to illegal content, including child sexual abuse material, or content that infringes anyone's copyright, trademark, privacy, or other rights;
- distribute malware or phishing, or anything meant to deceive or harm the people who see it;
- act as a general-purpose proxy or CDN, or serve images from buckets you don't control;
- get around metering, rate limits, or plan limits, including by spreading usage across accounts;
- send automated traffic at a volume that degrades the service for others, or load-test it without our written permission;
- probe, scan, or attack the service's security, other than reporting a vulnerability to us in good faith.
If we reasonably believe you've broken this section, we may block content, pause a project, or limit requests. We'll tell you when we can.
7. Copyright and abuse reports
To report an image served through ProdKit that infringes your copyright, or any other abuse, email support@prodkit.cloud with "Copyright" or "Abuse" in the subject. A copyright notice under the Digital Millennium Copyright Act (17 U.S.C. § 512(c)(3)) must include:
- your physical or electronic signature, as the copyright owner or someone authorized to act for them;
- the copyrighted work you say is infringed;
- the ProdKit image URLs of the material you say infringes it;
- your name, postal address, phone number, and email address;
- a statement that you believe in good faith that the use isn't authorized by the copyright owner, its agent, or the law;
- a statement that the information in your notice is accurate and, under penalty of perjury, that you're the owner or authorized to act for them.
When we receive a valid notice, we disable access to the material, which can mean pausing the project that serves it, and tell the customer. A customer who believes the material was removed by mistake can send a counter-notice to the same address with the information listed in 17 U.S.C. § 512(g)(3). We close the accounts of repeat infringers. Knowingly false notices or counter-notices can make the sender liable for damages.
8. Plans and billing
- Plan prices, included usage, and overage rates are listed on the pricing page. Paid plans are monthly subscriptions billed in US dollars, and they renew automatically each month until you cancel.
- Your first invoice covers the rest of the current month. After that, plans renew on the 1st of each month, and usage is counted per calendar month in UTC.
- Each plan includes a number of origin images a month. An origin image is one source file served during the month, with up to 5 sizes of it included; each further started block of 5 sizes counts as another origin image. Formats never count extra, and repeat views served from cache are free.
- Origin images beyond your plan's allowance are billed at the plan's overage rate after the month ends, on the invoice at the start of the next month. The Billing page in the dashboard shows the running total.
- Upgrades and switches between paid plans take effect immediately. The difference in base price for the rest of the month is prorated on your next invoice, and the new plan's allowance and overage rate apply to the whole month's usage.
- Prices don't include taxes. Where we're required to, we add sales tax, VAT, or similar taxes at checkout and on invoices, calculated by Stripe from your billing address. Businesses can add a tax ID at checkout.
- Payments are processed by Stripe. You authorize us to charge your payment method each month for your plan, any overage, and taxes until you cancel. We never receive or store your full card number.
- If a payment fails, your plan stays active while Stripe retries the charge. If it keeps failing, we may cancel the subscription, which moves your account to the Free plan and its limits. Amounts already owed remain due.
- Promotion codes apply only as described when issued, can't be exchanged for cash, and may expire.
9. Cancellation and refunds
You can cancel a paid plan at any time from the Billing page in the dashboard, which opens Stripe's billing portal. You keep your plan until the end of the period you've paid for, then your account moves to the Free plan. Overage from your final month is still billed.
Payments are non-refundable. We don't give refunds for partial months, unused included images, or usage already served, except where the law requires it. The one exception is a plan switch: when you move to a lower paid plan mid-month, the unused part of the old plan's price is credited to your next invoice, as described in Plans and billing.
If you think we charged you by mistake, email support@prodkit.cloud within 60 days of the charge. We'll look into it and correct any billing error we made. Please contact us before disputing a charge with your bank; it's usually faster.
10. The Free plan
The Free plan costs nothing and is never billed. It includes 1,000 origin images a month and one project.
Once a Free account reaches its monthly limit, ProdKit stops transforming its images until the next month starts (UTC). Image URLs redirect to the original files in your bucket, so images keep loading but aren't resized or converted. Those requests are served by your storage provider and count toward your usage there. Optimization resumes within about a minute of upgrading.
We may change the Free plan's limits or end it, with notice.
11. Changes to the service and prices
We may add, change, or remove features. If a change materially reduces what a paid plan includes, we'll tell you in advance by email or on the site.
We may change prices. We'll give at least 30 days' notice by email or on the site before a price increase applies to your subscription, and you can cancel before it does.
12. Support
Support is by email at support@prodkit.cloud. Paid plans include email support, Pro and Scale requests are answered first, and Scale customers can ask for custom limits or invoicing. We don't guarantee response times.
13. Suspension and termination
You can stop using ProdKit at any time. To close your account and delete its data, email support@prodkit.cloud from the account's email address. We cancel any paid plan when we close the account.
We may suspend or close your account, or pause a project, if you break these terms, don't pay, put the service or other customers at risk, or if the law requires it. We'll tell you by email when we can and, unless the problem is serious or illegal, give you a chance to fix it first.
If we stop offering ProdKit, we'll give at least 30 days' notice and stop charging you.
When an account closes, its image URLs stop working and we delete its data as the Privacy Policy describes. Amounts owed, and the sections on content, disclaimers, liability, indemnity, and governing law, survive.
14. Availability
ProdKit is in early access. We work to keep it fast and available, but we don't guarantee uptime or offer a service level agreement. The service can be interrupted for maintenance, by our providers' outages, or by events we can't control.
We may set technical limits, such as request rates or file sizes, to protect the service. ProdKit is a delivery layer, not a backup: keep your originals in your bucket.
15. Third-party services
ProdKit runs on other companies' services: Cloudflare (the image endpoint, transformations, caching, and stored copies), Supabase (our database and sign-in), Stripe (payments and tax), Vercel (the website and dashboard), and Resend (sign-in emails). Their outages or changes can affect ProdKit.
Your own Supabase project, including the bucket you connect, is governed by your agreement with Supabase. ProdKit isn't affiliated with Supabase or Cloudflare.
16. Disclaimers
ProdKit is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We don't promise that the service will be uninterrupted, error-free, or secure, or that transformed images will look identical to the originals. Resizing and format conversion are lossy by design.
17. Limitation of liability
To the fullest extent the law allows, Mythical Creature, LLC won't be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising from or related to ProdKit or these terms, even if we were told they were possible. Our total liability for all claims arising from or related to ProdKit or these terms is limited to the amount you paid us for ProdKit in the 12 months before the event that gave rise to the claim.
Some places don't allow these limits, so they apply to you only as far as the law allows.
18. Indemnity
If a third party brings a claim against Mythical Creature, LLC, its members, or its contractors arising from your content, your use of ProdKit in breach of these terms, or your violation of the law or someone else's rights, you'll defend us and pay the resulting damages, costs, and reasonable legal fees. We'll tell you about the claim promptly and let you control the defense, but you can't settle it in a way that admits fault on our behalf without our consent.
19. Governing law and disputes
These terms are governed by the laws of the State of Delaware, USA, without regard to its conflict of laws rules. Any dispute arising from them or from ProdKit will be decided only by the state or federal courts located in Delaware, and both of us consent to those courts' jurisdiction. If the law where you live gives you consumer rights that these terms can't take away, you keep them.
Before filing a claim, please email us so we can try to resolve it informally.
20. Changes to these terms
We may update these terms, and the date at the top shows the current version. For material changes, we'll tell you by email or on the site at least 14 days before they take effect. If you keep using ProdKit after that, the new terms apply. If you don't agree, cancel and stop using it before then.
21. General
- These terms and the Privacy Policy are the whole agreement between you and us about ProdKit.
- If part of these terms can't be enforced, the rest still applies.
- If we don't enforce a right, we haven't waived it.
- You can't transfer these terms without our written consent. We can transfer them to a company that takes over ProdKit, for example in a merger or sale.
- Neither of us is liable for delays caused by events beyond our reasonable control.
- If you send us feedback or ideas, we may use them without owing you anything.
- We send notices to your account's email address. You can send notices to support@prodkit.cloud.
